Evening all,

Just a quick question regarding clients who claim mileage instead of all costs for their cars.

I understand that they can claim 45p a mile for the 1st 10,000 miles and then 25p a mile thereafter.

What I am wondering is if a client uses their home as an office can they still claim for the miles used to get to and from work or contract.

An example is a small company who works all over the UK depending on the contract. I see this as purely for business as they would not have travelled there unless they acquired the contract, but is this correct?

Your opinions and experiences would be great...

Hi Ben,

This one's a more complex minefield than you probably imagine.

However, assuming short term site based contracts, provided that the contract does not go or is not expected to go over two years then this should be fine.

One issue with this sort of thing is that if someone signs a contract to work at a clinet site for 23 months then they should be fine.

If they sign a contract for 25 months then they are not entitled to claim mileage at all.

Where this gets really unfair is where the person who signed up for 25 months has their contract cut short at 23 months. In that scenario both contractors would have worked the same length of time but one would have been entitled to claim mileage allowance and the other wouldn't! Go figure.

The links are more important than EIM32132 itself. Take special note of the guidance in EIM32100 and EIM32134.

I'll take a read of the link provided but I can't promise I won't be back with any more related questions. From my initial reading, I definately agree that it may prove to be a minefield.
