Self employed - Thoughts please

Good morning everyone, I would like some input/advice. I am employed part time and also I am self employed have practice license, PII and MLR etc.... The question is, I have been offered a job on a self employed basis for about 10 hours a week for a small company. But, I would use their computer and they already have the software etc and would work onsite at their office. What do you think? Would I technically be self employed?

I would say yes. Many bookkeepers carry out work at client premises. As long as you have other clients or actively seeking other I dont see a problem.

Hi Georgie,

I'd ask the following questions:

1) To what extent are you under instructions or do you decide how the job is carried out?
2) Can you send someone in your place?
3) Does the contract have a limited period of time?
4) Do you decide which hours you work?

With regards to 2), if it is your wish to be regarded as self employed, then actually send someone in your place.

Thanks guys, my feeling is if I am not providing the tools for job i.e laptop, software etc then I wouldn't be classed as self employed. Think I will give this one a miss..... Now, where's that client bus !!

Hi Georgie

"Providing the tools" is only one of the tests, perhaps the client doesn't want another laptop on the network for security reasons. Maybe they don't want you to take their data off-site for the same reasons.

I'd consider the other tests Tim pointed out - personally , I'd consider 1. to be the most important.

2. Is difficult if you're a sole trader but not impossible
3. Can be agreed by negotiation and covered in your letter of engagement. I would imagine the majority of bookkeeping contracts are "open ended"
4. Is covered by an agreement between you and client

I would go for it.

I know someone who

1. Works 9-5 monday to friday in the same building (sometimes works later)

2. Has their own office

3. Has a company car

4. Is called the "sales director"

5. Doesnt have another "employment"

But isnt on the payroll and hands in his self employed invoice each month.  If he can do that i am sure you could as well.

Thanks for the input guys. It was easy to make my mind up in the end. He said he would pay me £8 an hour - self employed....So I told him I was busy washing my hair. And hey, times must be tough. I had a letter from an accountant yesterday congratulating me on my new business venture and offering a bookkeeping/accounts service to ME....Go figure!

Love it Georgie - I've had a few of those and they always make me laugh - do they not look at the business name before sending out mailshots???
