Taking on work unqualified for

Hi everyone,

I recently got a call via telephone from a person enquiring if I did work on payroll. Unfortunately owing to not being qualified for payroll I said to that person I have not the qualification to do this task. I would of loved to said "yes", and if that person was a potential client I would of loved to of worked for them.


Nonetheless, from this point I would like to know this:


"Can I get round to outsourcing the work I am unqualified to do or give someone who is qualified to carry on the work outside my practice to gaining a future client?"

It depends who your with. ICB have a rule against outsourcing work you're not qualified for, but recently revealed that they are aware it's happening and don't seem to be doing anything about it.

As that one makes no sense what so ever Kris...

For years bookkeepers have passed final accounts on to accountants to complete the work but surely that too would fall foul of that rule.

Actually, thinking about it we've not seen James on here for a while... Does he now restrict himself to the ICB forum?

Shame, the debates between Frauke and him made for an interesting insight into the different thoughts behind ICB and IAB approaches.

Fingers crossed he'll get tired of restricting himself to ICB chatter and pop back here imminently.

I think James misses a legal point there which you touch upon in your Homebase analogy.

All seems to me like the same legal situation as if you are in a ten car shunt. Each person claims against the next one back in the queue.

You are the provider and are responsible for your services even if provided by someone else and you would make good any issue but your insurance company or yourself would then go to the next person in the queue... Simples.

Following James Arguement nobody would ever be able to outsource anything unless they could actually do it themselves... Well, that just eradicated a fair chunk of the IT industry!

Now Shaun, I'm guilty of a lot, but never saying that the ICB forum gives loads of good advice. In fact a quick trawl will show that there is really little point in having the forum. Most questions are answered with the following "I think you really need to phone ICB on this one" what's the pont of a forum then??? (I normally hate overuse of punctuation, but in this case it's justified)
