Hi - Hope someone can help me! I work for an employment agency based in the UK, and currently supplying a Southern Ireland company who are working in the UK on a building site with self employed tradesman and they are telling me that I cant charge them VAT. Is this the case as the help line for VAT doesnt seem to know the answer!!!!! Help
There is a wider question as to whether the Irish company has to register for VAT in the UK. The 'Place of Supply' rules may well mean that it has to.
Leaving aside their problem, the Place of Supply rules for the supply of staff mean that the Irish customer has to give the agency its Irish VAT number. The agency then does not charge UK VAT.
