There was something in Accountancy Age last week about this.
As mark suggests this is probably down to the year end RTI process rather than a late post April submission.
were these clients early adopters of RTI as I vaguelly recollect that this was something peculiar to them.
Let me see if I can find it and I'll give you the link.

Has anyone else had this problem? I've had lots of clients ring me today saying they have received a letter from HMRC to say their submission for RTI is late which I can only guess is their FPS? And that they may get a penalty.
They are sending me a copy of the letter.
I have sent all FPS on time. Is this another error on HMRC's part?
It's obviously difficult to say for certain until you get the letter, I have often had clients phone/email saying that they have received a letter from HMRC stating this/that or the other then when the letter arrives it is nothing of the sort.
But for HMRC to state that they may get a penalty are they referring to this year or next because I didn't think they were issuing any penalties this year apart from when businesses pay them late.
If you are the authorised agent you should be able to discuss the letter with HMRC once you get it
Damn that I have so many subscriptions and every last one of them is complaining about what a bag a shit RTI is so its difficult to find the one that I remember that seemed apt to this thread.
Accountingweb have a bit of a smoother message here :
As Mark suggests you need to see one of these letters to see whether it relates to late filing of year end which under RTI is the 19th of April rather than the 19th of May and thats apparently caught out a good many early adopters.

If so that would follow the reports that I've been seeing in accountancy age and over of Aweb.

One was, but another most definately wasnt! In fact in the case of the latter the company had been struck off (for non completion of annual return) so HMRC's systems definitely failing there!

Thoughts are my own/not to be regarded as official advice, which should be sought from a suitably qualified Accountant.
You should check out answers with reference to the legal position
I know one of our clients had their PAYE scheme closed down due to inactivity as part of 'RTI cleansing' so that was the reason for their letter.
What made us laugh was that our accountancy practice had one of these letters too! We outsource our personal payroll to a large payroll beaureau and when we rang to ask why they told us we hadn't sent back a form to prepare for RTI. Surely though they haven't been able to submit FPS since April for us and would have got in touch? And surely the system won't allow them to process the payroll without doing an employer alignment submission first? I have no idea what system they use.
