Heres a kooky question...

 

Two directors work full time and run a company in their spare time.  Director 1 goes to the home of Director 2 most days, as this is where the business operates from (not reg office address, as service address being used).  Would this mileage be deemed as a commute rather than allowable mileage? I think so, but would appreciate comments

I would agree with you Michelle. Its a regular commute and by its nature there isn't even the two year temporary workplace get out.

Also, if the office of the business is at the home of one director is there any justifciation for use of home as office of the other director who works from the office in the first directors home?

I agree that the mileage of Director 1 going to Director 2 home would be a regular commute and, therefore, not allowable.

If you applied the decision from the Samadian Case to this, then HMRC would argue that their was a dual purpose to these journeys:-

- business motive to carry out his services;
- a non-business motive of maintaining his home solely as a home.
