A client of mine provides domestic workers for the elderly and is in the process of recruiting for a live-in domestic worker who would stay with the elderly person for a full week at a time. They wouldn't actually be constantly working, just on hand for whenever they were needed and would obviously sleep at night but might have to get up if help was required. They are paid per hour, for the full 24 hours each day but at a lower rate to factor in hours spent asleep, etc.
My question is what would be the best way to accrue their holiday entitlement? My client wants to give them the statutory 28 days holiday per year. The issue is that if we calculate the holiday per days worked it adds up very quickly, so if the domestic worker left the employment after two months they would have accrued more than 2/12ths of the annual entitlement.
I've never come across this situation before and wondered if there was a standard way it is done? I have spent a lot of time searching the internet for an answer but there is not a lot of guidance on this subject.
At the moment I am thinking that as long as my client is happy their employee is working enough to be considered full time then we should just divide the 28 days by 12 months and allow for 2.33 days per month.
I would be grateful for any input or suggestions on other considerations I might be missing!
