Hi all, would appreciate a second opinion, new co formed 8.10.12 filed tax return from 8.10.12-7.10.13 on 30.10.14 and accounts to 31.10.2013. HMRC have sent penalty notice, should we have filed a second return from 8.10.13-31.10.13 with accounts or is ok that only covered 12m?

You should have submitted two CT600s, one for the first 12 months, ie 08.10.12 to 07.10.13 and another short one from 08.10.13 to 31.10.13. Next year you will only need to do the one.

Thanks Rob. Thought that tbh. When I've called hmrc they advised me to appeal penalty. Unsure now whether to bother to appeal and whether should just pay the penalty for the client. Should I file the 2nd return now then do you think? Thanks

Yes you will need to submit the other CT600 Paying the penalty makes it go away and I guess you could tell the client that HMRC had an admin error and you successfully sorted it for them. I really don't know how successful an appeal would be but might be wortha try since if it's unsuccessful you can go back to plan A and pay the penalty and pretend you were successful!
