Deduction of Earnings Order
Permalink Closed

We have received one of the above for an employee for overpayment of benefit/crisis loan.  The amount to be deducted is a percentage depending on his earnings.

Are we allowed (at the employees request) to deduct the whole amount of the order and pay it off in one go rather than weekly at the set rate?

The employee disputes the debt which is why its got to this stage but just wants rid now.

Hello - Im pretty sure that whichever 'department' is responsible for the attachment would be very happy to get the full amount in one go. The instruction letter usually has some guidance notes and a helpline - worth giving them a quick call. Word of caution though - you absolutely must get something in writing from the employee for your own records to confirm this fact, otherwise you might end up in a dispute situation yourselves.

Thoughts are my own/not to be regarded as official advice, which should be sought from a suitably qualified Accountant.

You should check out answers with reference to the legal position
