Please anyone help me with my holiday pay for year 2015/2016 as it is approaching April I have to use up all my holiday entitlement.
I do 35 hours a week as below with flexbility because I got to do school run for my children,
Mon , Wed 6:45
Thu 6:00
Tue , Fri 7:45
Company policy For full time staff we have 31 day holiday entitlement plus 8 bank holidays . but for 2015/2016 there are 10 bank holidays.
I have holiday( including bank holidays) total hours 276.69 ( 35/37x 39*7.5) according to my line manager's calculation.
my annual leave will be calculated based on the hours for the day I normally work. for example, if I take day off on Thursday, so 6 hours will come out of my holiday entitlement.
Maybe I'm being thick but where does the 35/37 x 39 come into place? Also not sure where the 10 days bank holidays come in, as there are always 8 unless its a special extra holiday, the last one being the wedding of Will and Kate.
Under normal circumstances your holiday entitlement would be 39 days including bank holidays.. So in practice you would use a days holiday whether it was a Thursday or a Friday, or any other day.
But it depends on your contract. Does the contract say you would use 6 hours on a Thursday but 7.75 hours on a Tuesday or Friday? If it does that's what you go by, although I calculate 292.5 hours a year, which is why I need to understand where the 35/37 comes into play.
If your contract says 35 hours a week and 39 days a year then my way is correct, not the line manager's. If it says you use hours according to the day you take off, it's the line manager who is correct, although I disagree with the ~270 hours.

So by my reckoning you work 35 hours a week over 5 days giving you 7 hours a day on average. Multiply this by the 39 days and you have 273, in which case I wouldn't argue with the line manage. I think the managers calculation should be 35/37.5 on the assumption that they consider normal full time as a 7.5 hour day, in which case you come back to 273 again.
Just a quick one to throw in the mix (only popped in for a couple of mins as Im mega busy!)
When does the actual holiday year start and finish Grace? Dont assume because you have to use them all by xx April that that is the date. Ive known companies who use the calendar year for calculation but then allow you to carry over some holidays but they must be used by xx date the following year. I agree with the guys in that your contract is your first port of call in answering this one and more info is required.
Where did you get 10 Bank holidays from - are you counting some Scottish ones as well? lol. Wish we had Bank holidays off - but as self employed mostly have no idea what day of the week it is as they all morph into one another!

I did wonder that too - in part why I suggested she check her contract, also as we didnt have a set date in April to work with. Some bizarrely have it mid month, some the end.

Sorry , it is 10 public holidays and bank holidays.I am working for a charity in Leeds. My holiday starts from 1st Apr 2015 to 31 Mar 2016. My company doesn't allow us to carry over some holidays. In my contract, it just says 35 hours with the flexbility ( nothing else specified).

just confirmed with my line manager , you calculation is correct. it is 273 hrs for my holiday.
