A payroll client of mine pays overtime at time and a quarter if you work between 6am and 8am (normal hours are 8-145) An employee whose normal hours are 8-14.45, wants to change his hours over Easter to 6am -12 because of family commitments. The employer is allowing this, but is under the impression that she should pay him the overtime rate for the two hours per day that fall into 6-8am. I don't think that she should as she isn't asking him to work overtime, he is choosing to work those hours. Am I right or should she pay the overtime rate?
Many thanks for reading
