Company striking off - who to tell in HMRC?
Permalink Closed

Hello good people,

Does anyone know which part of HMRC should be supplied with a copy of a Company's form DS01 when starting the Striking Off process?
I would have thought it would be the Company's Corporation Tax office, but is there a more specific office to send it to?

Thanks

Andy

Andy....I don't think you have to at all. The form should be sent to Companies House (the address will be on the form) .....you may even be able to do this online. I think they then take care of the rest.

Hi Andy,

If changing a company name is anything to go on I wouldn't be surprised if had you had to send it in you may have had to send it individually to each department as they really don't seem to talk to each other at all!

kind regards,

Shaun.

Thank you both - I took a punt and phoned up the client's CT office to enquire, and they confirmed that it was they who needed the form.

To apply to strike off your limited company, you must send Companies House form DS01.

The form must be signed by a majority of the companys directors.

You should deal with any of the assets of the company before applying, eg close any bank accounts and transfer any domain names.

When your company is dissolved, all the remaining assets will pass to the Crown (including any bank balances).

It costs £10 to strike off a company. You cant pay using a cheque from an account that belongs to the company youre striking off.

It is an offence to make a dishonest application - you can face a fine and possible prosecution.

What happens next

Youll get a letter from Companies House to let you know if youve filled in the form correctly. If you have, your request for the company to be struck off will be published as a notice in your local Gazette.

If nobody objects, the company will be struck off the register once the 2 months mentioned in the notice has passed.

A second notice will be published in the Gazette - this will mean the company wont legally exist anymore (it will have been dissolved).

Ellenaparker - why would you respond to a post that is from 2011? Plus add a link to a 'nothing' /waste of space website - which according to your profile is your own site.

Sorry to say Debbie but this combined with her other post (and a couple of other weird hints, which I wont publish so I dont give the game away to the next spammer) leads me to suspect spam and link building! Happily be proved wrong of course.

Wah hey, well done Joanne.

Just for reference to anyone picking up on this thread:

If striking off a company using the Companies House DS01 form, you must inform all creditors within 7 days of doing so, giving the creditor the opportunity of winding the company up if they want to do so.

I've got to admit that I was a bit mystified when an old posting of 5+ years ago suddenly came back to life.
But I did enjoy seeing the spammer-sleuthing masterclass
