Changed job within a company, act as self employed not sure if I need MLR
Permalink Closed

I have worked for a drama school for 6 years within administration, which means a Saturday morning and afternoon and a couple fo hours in the week to deal with email queries.  In December, they wanted to bring the accounts  inhouse and I have taken on the bookkeeppers role and givem up the admin completely.  All their staff work on a self employed basis.  As i am now doing the books, and they won't take me on as employed, does it mean that I have to register for MLR?

Also, I work a couple of days from their offices, but if the children are home from school, they don't mind if I work at home.  Does this mean that I will have to register 2 addresses?

Really worried about this as I hadn't bargained on the extra cost, as in my mind I work for them but really for HMRC purposes I am going to be completely self employed.

Thanks for any advice.

Hi VickiJ,

if you are working on a self-employed basis then I believe you need to be supervised for MLR as you will be providing bookkeeping services to others. There is a cost associated with registration for MLR with HMRC, but you should be covered automatically if you are a member of a supervisory body (e.g. ICB).

When you register as self-employed you just need to provide your business address, not all the address from which you work. In your case I would register your home address as your business address for self-employment purposes, even if you sometimes carry out your work at the school's premises.

Hope this helps.

thank you for this.. do you know how much work I would have to do at another site to have to pay the registration as it seems to be against premises as opposed to clients?

I'm not any member of any body yet, but have 10 years financial experience prior to this job.  I'm hoping to become ICB or IAB in teh near fture though so I should only have the one year to subscribe before I can get cover (assuming I qualify)

I'm afraid I don't understand the question... :o)

MLR supervision must be in place when you start your bookkeeping business. This is to be compliant with the law. MLR registration does not depend on number of clients or business addresses.

Have I misunderstood the question?

Sorry, probably not making my myself clear. I have copied this bit from the HMRC website:

"You'll need to register each place where you carry on any of the business activities that HMRC supervises. There is a fee for registering each premises for the first time and also an annual renewal fee"

They include home as a separate premise, as well as offices where you conduct/need to be HMRC MLR supervise.

This is why I'm not very sure what I should do?

Thanks Vickij

I see what you mean now.

I'm supervised by the ICB so I was not aware of that statement from HMRC.
It still sounds very strange to me that you have to register every single address where you carry on bookkeeping because if you offer one-off bookkeeping activities (retrospectively for the year) to different clients and do so at their office you will have to register a massive list of addresses.
We may be interpreting that statement from HMRC a bit too literally. Did you try to call HMRC and ask for their advice? I know that we are all reluctant to do so, but sometimes it seems to be the only option.

Sorry that I can't be of more help.

Hi Vicki,

afraid you've slightly misunderstood the HMRC website. (it's not the first time that line has been misunderstood by people on the site as the lines not particularly well phrased).

The only premises that you need to register are your own.

think of it this way.

Imagine as a bookkeeper of accountant you have 60 clients that you visit. you don't register your business at 60 seperate premises.

What they are actually talking about is your premises so if, for example, you do business from an office and also have an office at home where you see clients then you have two premises that would need to be registered. You would not register the businesses of clients as your offices for MLR purposes.

Most bookkeepers who register for MLR through HMRC register their home address for supervision purposes.

Welcome to the forum,

Shaun.
