Stupid question no. 101.... (only kidding!...well about the 101 anyway)
If an employee is currently on ordinary maternity leave which ends at the end of June (the 39 weeks) and is receiving Maternity Allowance as she wasn't entitled to statutory maternity pay and she wishes to hand in her notice, her maternity allowance doesn't stop when she leaves employment does it? She is not getting another job, just leaving.
I'm thinking on the same lines that providing she doesn't get another job, it would operate like SSP and the allowance carries on. I tried to escalate this question but my contact (who might not know anyway) is away for a week. There is one other person I can ask who I will see on Monday. Barring a definitive answer, I can't see anything in the regulations but haven't gone so far as to check the legislation. Tim
Thanks for the reply. I can't see anything in the regulations either, but the employee probably won't give her notice in until the end of June anyway, to make the most of accrued holiday. Maybe your contact will know something :)
Hi, I had a word with my other friend last night (after the disastrous football match) and as helpful as she is, she didn't know the answer off hand but that you would receive confidential advice from the CAB and ACAS. I'll post as soon as I get anything more definite. Tim
