Maternity pay - will I still be paid by last months maternity pay if I hand in my notice?

I am currently on maternity leave until Jan 14 and on paid maternity leave until 25th October. I want to hand my 1 months notice in on the 25th September so that I can do self-employed work and also try and claim some working tax credit to top this up.

I just want to check this, my last pay date of smp is on the 25th October for the period 26th Sept - 25th Oct. If I hand in my 1 months notice on the 25th September will I still be paid my maternity pay on the 26th October? I' worried that my employer will mess this up if I hand in my notice.

Will I also be due any holiday pay? the holiday year runs from Jan - Dec, I have not taken any holiday this year and started my maternity leave on the 26th Jan 2013.

Hi Rachel,

can't you just inform your employer that you will not be returning after smp. I think this is quite common as obviously some mums decide to stay at home to look after the baby so shouldn't be a problem.

Hi Rachel,

Yes, it will be fine to hand in your notice, you will still be paid your month's SMP to 25th October.  You continue to accrue holiday whilst on maternity leave too, so as you haven't taken any for this holiday year you should be paid pro-rata up until 25th October.  (If you work 5 days a week, this will amount to 22.9 days holiday pro-rata).
