RTI late notices when it was an additional notice mid month

Hi Guys

Thought I should highlight this one and of course get any views.....

I did a clients wages at month end, including a leaver and his P45 and RTI was done on time.   Then the leaver queried his holidays/wages (he was sacked and it got acrimonious) and in the end the boss agreed an extra days holiday was due.

I re-did the wages and P45 and submitted a further RTI   (I use 12Pay and so had to do a roll-back and re-submission)  - this was done on 13th.

I then received a generic notification from HMRC which indicated I had submitted a late RTI return on 13th!!!!

Currently there are no fines but this could be one scenario where they could be fined after April 2014 - I think this would be wrong/unfair, so I called HMRC.   They have had a few such calls recently but have not yet got a 'formal response' ready as to whether or not you would be fined.  (Their agent even suggested waiting to key in the leave date - which I dont think is an option for an ex-worker who is entitled to get their P45 promptly!).  They are collating data and will no doubt come out with some message idc. hmm

Just wondered if anyone had any similar experiences/advice that can be shared.

Hi Jo.

The holiday pay could have been regarded as correct at the time of the first filing, so you could re-start his employment purely to put through the extra day. Given the possible RTI fines and your concern re. prompt P45, waiting could also make you late.

I assume there are going to be a couple of 'lives'.... chances during the year before an actual penalty kicks in. I also think these chances could be reduced after a couple of years as RTI beds in.

Interesting!! HMRC not got their act together as usual, so I guess we have to just keep feeding it back to them and hoping they will sort it in the end.

Loving the disguise - very festive, although a bit scary too!
