Some questions on P11D
Permalink Closed

I haven't done any of these since 2008 and this year I get two!  First one is straightforward but second one is a lorry driver employed through their own Ltd Co, a new client I have recently taken on.

As far as I can ascertain mileage allowance, overnight subsidence, overnight incidentals and daily meal allowance don't need to be put on P11D.  As far as I know there is no dispensation for this company so any other meal claims will need to go on a P11D, is that correct?

Also can I clarify that if overnight subsidence has been claimed, then the late meal allowance doesn't apply nor the early breakfast?  I have a blank expense claim form from the previous accounting firm and on there it states Lunches Breakfasts £7.50 a day (I know thats wrong)/meals after 8 pm £15/overnight £25/overnight incidentals £5 no receipts required.  How can early/late meals be set if there is no dispensation?

Also does anyone know what the overnight rate is for 2014 and 2015.  I've searched but even the HMRC website only goes up to 2013.  Rates are supposed to change each January.

John check out the Road Haulage Association website as they have agreements with hmrc on allowances.

Cheers Rob, couldn't get it directly from RHA site but a search including RHA got me a link to the 2014 allowances.  It's possible the 2015 rate hasn't come out yet because the link was dated 16th April 2014.

Please could you clarify whether my assumptions re P11D are correct

Hi John,

I pulled this up from the RHA:

www.rha.uk.net/docs/documents/Subsistence_Payments_for_Drivers_2012.pdf

Seems to be saying that mid day meal and over night meal should be on the P11D. Complete waste of time though as it is not taxable.

Hi Rob, that was one of the first documents I read when researching this. The overnight subsidence and the midday meal is something that has been agreed with HMRC so I'm with you regarding the P11D

My concern is regarding early breakfasts and late meals when not stopping out overnight.  The previous accounting service has allowed claims for these costs un-receipted, but it's my impression from what I've read that f wheres there's no dispensation in place, receipted expenses must be provided, and included on a P11D

It's just dawned on me that it's a moot point anyway because they are under the £8500 figure for 2014-15.

However, moving forward, it's my intention to apply for dispensation for 205-16, as I intend getting the client to  agree a higher salary anyway.
