Maternity Leave/Pay

Good morning all.

I have an employee who is having a baby in November 2015.  She has informed the employer that she intends to work up to at least 4 weeks before the due date, but, she has no intention of coming back to work after the baby is born.  Does the employer still have to abide by the usual maternity leave/pay rules ?

Hi Andrew

Yes, with regard to statutory maternity pay/leave. Any company maternity leave/pay will be as per the internal policy.

Hi Andrew

Yes, they would need to pay statutory maternity pay if the lady in question leaves within the last 15 weeks of the due birth date.  If the lady hands in her notice then any any other employee benefits (eg holidays) would end once she's served her notice.

That's great. Thanks both. Was hoping my thinking was correct, but wasn't 100% sure, and always good to double check !
