Hi,

Well I've never come across this before....Clients staff are paid an hourly rate. This month they want to pay their staff  holiday pay at a lower rate per hour than when they work. Is this allowed?

Hi Georgie. It sounds like he's not bothered if there's a dispute.

If he has good reason to think they're NOT entitled then he should call it something other than Holiday Pay. Otherwise, just follow the usual guidance for the circumstances.

Hi Don,

Sorry i don't understand your answer. His staff are paid £7.50 an hour but wants me to pay them £7.40 holiday pay...

Hi Georgie, given the 10p difference it sounds like he's looking for a fight. Does he give any grounds for wanting to pay this fraction less?

No, he's just tight I guess. I wanted to know if can do this before I question him about it.

No you can't do this. If that is their rate then that's the rate that is paid. If they work different rates for different jobs you would use the average from the previous 12 working weeks.

Unless there is something already in their written contracts Georgie. Possible, albeit rare these days. Otherwise as the other guys say - its wrong and I would be telling him that I wont be party to breaking any rules.
