Hi, I have searched the site for this question as I thought it would have been talked about before...I can't find it if it has.
I have a couple of clients who are contractors and hire subcontractors. I'm getting a bit flustered thinking that they may need to become employees as they are working regularly (most of their working week) for the contractors, although they all do other extra work they all spend most of their time working for the contractor in both cases.
I've goggled about a bit and I can't really find a straight answer and I feel like I need to say something if they are doing this wrong and should be employees
Does any know where I can find a guide for this to make sure it's being done right? or perhaps just knows whether this is right or wrong.
Its always an issue with sub contractors, especially as when they are working on long projects and contractors always use people they know and trust.
I get my clients to run through the Employment status indicator https://www.gov.uk/guidance/employment-status-indicator Can't guarantee they have answered honestly or correctly but it does make them think about it. They can keep the result to show HMRC if they are ever investigated. Not sure how much weight it would hold but at least they have tried to do the right thing.
