I feel a daft question coming on..... If a client takes on a subbie and they say they are not CIS how would you know ? If you are not operating a PAYE scheme you can't verify them can you?
no such thing as a daft question especially when it comes to CIS.
Depends why they are saying they are not CIS. Is it because the work they do doesn't fall within in CIS? Client had this with a blind installation company. If the work does fall in CIS you verify them, they won't be found and you deduct at 30%. They do have to have a PAYE ref to operate CIS.
My client works for a large D.I.y chain fitting bathrooms for their customers and they deduct 20% from him. He is doing very well and also has his own private work. He has taken on a subbie himself to help him , so should this guy be CIS?
If he is sub contracting part of the sub contract then yes. But careful if he is just 'helping' with the overall contract as this implies employment, so he would need to process through PAYE.
I suspect the former though as this is very common in this industry.
