Tax Return for deceased party
Permalink Closed

Hi

I'm hoping someone can help. My father-in-law passed away a few weeks ago, he had meant to request me to do his tax return for 2015-16, however, never got round to giving me authority over him with HMRC.

I am trying to help his wife, my partner & his brother sort out everything (as noone has any idea what to do).

I know someone is going to have to complete the tax return on his behalf. Is this something I can do, or can I just prepare & get his wife to sign off on his behalf as a next of kin. I presume this will have to be done on paper and not electronically.

He will also have a small income this year from property rental, however, I doubt he will have an tax liability from this. Does this also have to be completed now before all the probate etc has been sorted? He has been poorly for some time, so he hasn't worked for a while, but did get some DLA.

Thanks Lyndsey

Hi Lyndsey
Sorry to hear your sad news.

You may need to complete other returns depending on what happens with his estate, but the first thing to do is to contact HMRC, they have a dedicated team. Here is some info and the contact number....

Thoughts are my own/not to be regarded as official advice, which should be sought from a suitably qualified Accountant.

You should check out answers with reference to the legal position

I have a similar case where I hadn't yet got someone to sign up, and then they passed away suddenly, so those contact numbers are very helpful. Thanks Joanne.

Sorry to hear your news Lyndsey
