Filing penalty for SA submitted on 30th January

I've received a filing penalty for a client, but double checking it was submitted via Taxfiler on 30th January and has an IR mark.  On the online agents account isn't giving me the option to submit the return through the online portal, it just says

"Tax year ending 05 Apr 2017.  You can file or amend your tax return using commercial software" 

 

Another client who is late it says  "Tax year ending 05 Apr 2017.  HM Revenue & Customs (HMRC) sent you a notice to complete a tax return on 06 Apr 2017 but have not yet received it.  You can file returns using the HMRC Service"

 

So I wonder if this is the reason?

What's the best course of action, phone call or just appeal the penalty?

Hi John

I would give the Agent helpline a ring and see what they have to say about it considering that you have the Taxfiler submission receipt as well as the confirmation email from HMRC, you never know you might get lucky and they will squash it there and then, however I reckon they might tell you that you have to appeal, either way I cant see the penalty being upheld

It must be showing on their system as received otherwise they would not be giving you the option to amend it, I am just wondering is it because when you submit with Taxfiler it can take several days before it shows on the client account as received and that maybe the system picked up that it was still not showing on Jan 31st and therefore late, even though it had been submitted and received

Hi Doug

Spoken to a helpful lady at HMRC and she has taken the IR number and is referring it to another department, who will look into it and let me know.  I've to allow them a month which is fine and hopefully it will be sorted out.  

It's definitely not showing on their system has received so must be a glitch in their systems somehow, I filed some returns after that using Taxfiler and they've gone through ok, as I checked every single client this morning, just to be sure!!

The directors of my company have received a penalty. The accountant submitted the return on time and my colleague paid the tax due (on dividends) as I was sitting opposite her on 29th so there must be an issue somewhere.January

Unfortunately, I have to confess that the error, wasn't in fact down to HMRC, but to yours truly!

When doing the return I had omitted a minor detail (didn't affect anything but should have included it).  I realised immediately and resubmitted it (probably within 5 minutes)  and marked it as amended.  Only it wasn't because I hadn't actually submitted the first one even though I thought I had.

Nice letter from HMRC informing me that they had received the amendment but not the original so they were treating it as the original and cancelling the penalty!  So credit where credit's due.
